HIPAA Privacy Policy

This HIPAA Privacy Policy describes how Beyond Elite Health may use and disclose your Protected Health Information (PHI), your rights regarding that information, and our obligations to protect it.
1. Our Duties
We are required by law to maintain the privacy and security of your PHI.
We will notify you in the event of a breach of your PHI.
We must provide you with this policy and follow its terms.
2. Information We Collect
We may collect the following information to provide care and optimization services:
Intake forms and clinical notes you provide.
Data from wearable devices (such as Garmin) stored in MedM.
Reports and assessments generated during your care.
Your information is securely stored in:
Google Workspace (Drive, Docs, Sheets) for long-term records.
MedM for biometric monitoring data.
Telehealth platforms (Zoom, FaceTime) for consultations.
3. How We Use Your Information
We may use your PHI to:
Provide, coordinate, and manage your care.
Review wearable and lifestyle data to create recommendations.
Communicate with you about scheduling, reminders, and program details.
We will not use your PHI for marketing purposes without your written authorization.
4. How We Share Your Information
We may disclose your PHI:
To you: through secure Google Drive folders or during telehealth visits.
To service providers: such as Google and MedM, who have Business Associate Agreements (BAAs) with us to protect your data.
As required by law: in response to legal processes or public health requirements.
We will not send PHI by unencrypted email.
5. Your Rights
You have the right to:
Access and receive a copy of your records.
Request corrections to your PHI.
Request restrictions on certain uses or disclosures.
Receive an accounting of disclosures of your PHI.
Withdraw consent at any time (except where we have already relied on it).
6. Telehealth Disclaimer
We use Zoom and FaceTime for consultations. These platforms use encryption but may not meet all HIPAA standards. By working with us, you consent to their use for your sessions.
